01. 1. This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

I.A. No.2206 of 2024

2. Heard learned counsel appearing for the appellant as well as learned counsel for the State.

3. The present application with a prayer for condonation of delay of 26 days in filing the appeal.

4. Learned counsel appearing for the appellant at the outset contended that since date of judgment the appellant is in custody. Therefore, he could not arrange funds to engage a counsel and accordingly, preparation and presentation of the appeal got delay. On such ground, learned counsel for the appellant contended that the delay, if any, in filing the appeal be condoned.

5. Learned counsel for the State on the other hand objected for

condonation of delay by saying that the delay has not been properly explained.

6. Having heard the learned counsels appearing from both sides, this Court is inclined to condone the delay of 26 days in filing the appeal on the ground that the appellant is facing substantive sentence on being convicted under Section 20(b)(ii)C of NDPS Act.

7. Accordingly, the I.A. stands allowed.

8. List this matter in the next week under the heading of "For Admission".
