01. 1. This matter is taken up through hybrid arrangement.

2. In filing this Writ Petition, the Petitioner being an

encroacher has challenged the impugned notice of

eviction dated 16.04.2025 as the same has not been issued

in terms of the judgment dated 01.02.2024 passed in

W.P.(C) No.24066 of 2023 with batch of cases and also the

order dated 04.03.2024 passed in W.P.(C) No.4496 of 2024

with batch of cases.

3. Heard learned counsels for the Parties.

4. Let notice be issued to the Opposite Parties.

5. Learned counsel for the State waives of notice on behalf

of the Opposite Party Nos.1 and 4. Let two spare copies

of the brief be served on her to take instructions in the

matter.

6. Learned counsel for the Petitioner is directed to serve

an extra copy of the brief on Mr. Jugala Kishore Panda,

learned counsel who usually appears on behalf of the

Bargarh Muncipal Council/Opposite Party Nos.2 and 3

within three working days hence. He is also directed to

take instructions in the matter.

7. List this matter on 25th June, 2025.

2. Issue notice as above.

3. As an interim measure, it is directed that no coercive

action shall be taken against the Petitioner pursuant to

the impugned notice of eviction dated 16.04.2025 till the

next date of listing of this matter.
