Pursuant to the order dated 29.10.2024, the notice was issued to the opposite party No.2. However, the same was returned with postal endorsement that "addressee left without instruction".

2. In view of the Judgment of the Hon'ble Supreme Court in the case of C.C. Alavi Haji v. Palapetty Muhammed, reported in 2007 (6) SCC 555, the service of notice on the opposite party No.2 is deemed to be sufficient.

3. List this matter for hearing on 19.12.2024.
