04 1. Mr. S.R. Mulia, learned counsel for the petitioner submits that in
Criminal Revision No. 346 of 2022 filed by Nasim Khan vrs. State of
Odisha, a learned Single Judge of this Court has referred the matter to a
larger Bench as there are two conflicting judgments on the point
whether an application under Section 457 of Cr.P.C. will be
maintainable for interim release of a vehicle which has been seized
under the NDPS Act during investigation or trial of the case.
2. Mr. S.R. Mulia, learned counsel for the petitioner states that this
Revision is still pending for decision before the Division Bench.
3. Considering the said submission, list this matter on 09.05.2024 to
enable Mr. S.S. Mohapatra, learned Additional Standing Counsel to
obtain instructions regarding the status of the Criminal Revision No.
346 of 2022 and the connected cases.
