02. 1. None appears for the petitioner at the time of call.
2. Instant petition under Section 482 Cr.P.C. is filed by the petitioner seeking quashment of the order dated 31st July, 2023 passed in G.R. Case No.745 of 2022 by the learned J.M.F.C.(O), Bhubaneswar and to release him on bail in terms of Section 167(2) Cr.P.C.
3. In fact, on an earlier occasion, the petitioner had approached this Court in CRLMC No.3379 of 2022 to quash the FIR and also the criminal proceeding pending before the learned court below arising out of Nandankanan P.S. Case No.0093 of 2022 and the same was dismissed on merit by a judgment dated 21st March, 2023.
4. Since none appears today and instant petition relates to default bail as per Section 167(2) Cr.P.C., the Court is not inclined to entertain the same as such remedy may be availed of before the learned court below and accordingly, the CRLMC stands dismissed.
