MATA No.230 of 2024 and I.A. no.261 of 2024 Order No.
01. 1. Mr. Bose, learned advocate appears on behalf of appellant-
wife and submits, his client is aggrieved by judgment dated 7th March,
2024 of the Family Court, whereby her marriage with respondent-
husband stood dissolved. Without prejudice he submits, direction for
permanent alimony at ₹8,00,000/- (rupees eight lakhs) was also
inadequate.
2. His client also filed application for condonation of delay since
the appeal was filed beyond the time prescribed by Family Court's
Act, 1984.
3. It appears from the stamp report that limitation has been
reckoned at period of 90 days, as prescribed by Hindu Marriage Act,
1955. We accept the report. As such, there is no delay and no order
need be made on the application for condonation. It is disposed of.
4. Appellant will put in requisites for issuance of notice of
appeal. The lower Court record be called for.
5. List on 19th July, 2024.
