05. 1. Heard learned counsel for the Petitioners and learned counsel for the Opposite Parties.

2. The present Writ Petition has been filed by the Gana Sikshyak for engagement as Zilla Parishad Teachers inter alia on the ground that they have completed six years as such Gana Sikshyak and they all have requisites academic and training qualification.

3. Learned counsel for the State seeks an adjournment to obtain instruction in terms of the order passed by this Court on 03.07.2023.

3. Learned counsel for the Petitioner relied upon the judgment in Dhananjay Charan Dey & Ors. Vs. State of Orissa & Ors. reported in 2020 (II) ILR - CUT- 84 and submitted that the issue has already been settled and hence the relief as prayed for is to be granted.

4. Learned counsel for the Petitioners submits that the said judgment of the Co-ordinate Single Bench was assailed in W.A. No.9 of 2021 and the W.A. dismissed by order dated 19.02.2021. Challenging the same, the matter was carried to the Apex Court in SLP No.13627 of 2021 and by order dated 25.01.2023, the SLP has been rejected and the order in Dhananjay Charan Dey (Supra) has attained finality.

5. In view of the same, learned counsel for the State is called upon to obtain instruction.

6. It is the further submission of the learned counsel for the Petitioners that the Odisha Administrative Tribunal in its order dated 10.03.2015 have already granted relief to similarly placed Gana Sikshyak. And, such order has been implemented.

7. Copy of the order in intra-Court appeal and the SLP is taken on record.

8. Accordingly, list this matter on 30.01.2024.

9. Copy of this order be made over to the learned counsel for the State.
