01. 1. This matter is taken up through hybrid
arrangement.
2. Through this writ petition the Petitioner claimed
that his application for appointment as against the post of
Sikhya Sahayak has been rejected by the Opposite Party
No.2 by its order no.10450 dated 01.11.2021 vide
Annexure-10.
3. At the time of hearing, learned counsel for the
Petitioner submits that this case is covered by the
judgment dated 23.12.2020 passed in W.A. No.701 of
2019, which has also been upheld by the Supreme Court
in SLP (C) No.5660 of 2021.

4. In such view of the matter, let the notice be issued
to the Opposite Parties.
5. Mr. Dash, learned ASC accepts notice on behalf of
all the Opposite Parties. Let two extra copies of the brief
be served on him within three working days hence.
6. Mr. Dash, learned ASC is also directed to examine
whether the judgment noted hereinabove is applicable to
the present case or not.
7. List this matter on 3.10.2023.
