02. Adalat, 2023.

2. Learned Counsel for the parties are present.

3. Since the award dated 18.05.2023 passed in Misc. Case No.1040 of 2016 has been challenged by the Insurance Company in MACA No.766 of 2023 so also the Claimants in MACA No.781 of 2023, the same are disposed of vide this common order as per the Compromise Petition jointly filed by the Parties.

4. Though the awarded amount is Rs.8,83,400/- along with interest as detailed in the impugned award, the Parties have agreed to settle the dispute at Rs.11,00,000/- (Rupees Eleven lakh) consolidated towards full and final settlement of the claim, to be deposited within eight weeks hence before the Tribunal.

5. On deposit of such amount, the Tribunal shall reapportion the said amount amongst the Respondents in MACA No.766 of 2023 in terms of the ratio fixed in the impugned judgment and accordingly, resettle the amount in favour of the Respondents (claimants before the court below) in accordance with law at the earliest.

6. Accordingly, both the MACAs stand disposed of.

7. Since the matter has been settled amicably, the statutory amount deposited by the Insurer Company in MACA No. 766 of 2023 before the Registry be refunded to the Appellant Company along with accrued interest, on production / filing of receipt in proof of deposit of the compromised amount before the Tribunal.
