04. 1. The petitioner has filed this application seeking clarification/

modification of the judgment dated 29.09.2023 to the effect that in para-6

of the said judgment, an error has been crept in.

2. At page-7 in quotation para-6 of the judgment dated 29.09.2023, it

has been stated that "for closing the departmental proceeding in view of

the order dated 07.04.2021 passed in W.P.(C) No.11677 of 2021", the

said portion needs to be removed.

3. Accordingly, at page-7 in quotation para-6 of the judgment dated

29.09.2023 in W.P.(C) No.28666 of 2022 is modified and replaced by the

following paragraph:

"6. Even after closing the departmental proceeding by the detailed aforementioned judicial order, the Opposite Party No.3 by clearly disobeying the order of this Court proceeded with the departmental proceeding. Therefore, the petitioner has to file repeated proceedings before this Court and filed 3rd writ petition being W.P.(C) No.26715 of 2021, which was disposed of with a direction to consider the representation filed by the petitioner. Subsequently the petitioner had also to file a Contempt Petition being CONTC No.2755 of 2022. While dealing with the said Contempt Petition, the learned Single Judge again directed to comply with the previous order of this Court dated 17.09.2021 passed in W.P.(C) No.26715 of 2021."

4. In view of the above modification, the I.A. is disposed of.
