Order No. 17.10.2023 I.A. No.294 of 2023 and CMAPL No. 669 of 2023
01. 1. The above interlocutory application has been filed by the petitioner seeking condonation of delay of 208 days in filing the restoration application.
2. It appears that that the writ petition, which is sought to be restored by way of the restoration application, was dismissed on 16.01.2023 for non-prosecution. Delay has not been properly explained in the application for condonation of delay.
3. In view of the judgment passed by this Court in State of Orissa and another v. Bishnupriya Routray and Another, 118 (2014) CLT 588, this Court is not inclined to condone the delay of 208 days in filing the CMAPL application.
4. Accordingly, the I.A. stands dismissed. Consequentially, the CMAPL stands dismissed.
