02. 1. Mr. Debata, learned advocate had moved this appeal on
6th October, 2023 before the Bench, where one of us (Arindam
Sinha, J.) was a party. Direction for service by dasti was on
reason in paragraph-9 of order made that day, reproduced
below.
"2. Bare perusal of impugned judgment reveals the Court below found the delay to be more than 2 and ½ months in preferring the proceeding after knowledge on 26th September, 2022, more than 1
and ½ months beyond the statutory provision and article 123 in Limitation Act, 1963."
He submits, service has been effected. He causes filing of
memo of date enclosing the service return.
2. Mr. Pradhan, learned advocate appears on behalf of
respondent-husband. On query from Court he submits, his
client has no intention to get remarried in recent future.
3. We accept submission made on behalf of respondent-
husband regarding his intention.
4. List the appeal on 16th November, 2023.
