                                                 ORDER

13.10.2023

Order No. This matter is taken up through hybrid mode.

01.

2. Heard Mr. M. Kanungo, learned Senior Advocate appearing along with Mr. S.K. Meheralla, learned counsel for the petitioner.

3. This review petition has been filed seeking review of the order dated 19.07.2022 passed in W.P.(C) No. 17546 of 2011.

4. Mr. M. Kanungo, learned Senior Advocate appearing for the petitioner contended that the management/opposite party no.2 filed and proved before the tribunal the letter dated 05.09.2001 issued by the licensing officer, Government of Odisha marked as Ext-A which was the license granted to M/s. Balaji Traders/ opposite party no.4 under Section 12 (1) of the Contract Labour (Regulation & Abolition) Act, 1970. This document proved that opposite party no.4 was not a contractor. However the same has not been taken note of while passing the judgment dated 19.07.2022 in W.P.(C) No. 17546 of 2011.

5. Mr. P.P. Mohanty, learned Additional Government Advocate contended that in the judgment passed by this Court, the same has also been taken into consideration and, as such, the review petitioner has not made out a case for review of the said judgment.

6. Having heard learned counsel for the parties, as it appears the claim

which has been made by the petitioner in the present review petition has already been taken note of in the judgment of this Court dated 19.07.2022 passed in W.P.(C) No. 17546 of 2011. Thus, this Court is of the opinion that the review petitioner has not made out a case for review of the said judgment.

7. The review petition stands dismissed accordingly.

                                                                                   (DR. B.R. SARANGI)
                                                                                 ACTING CHIEF JUSTICE

                 Arun (R.K. PATTANAIK)
                                                                                             JUDGE
