03. 1. This matter is taken up through hybrid arrangement
(virtual/physical) mode.
2. Heard learned Counsel for the Appellant and on going through the judgments passed by the Courts below, the Appeal is admitted to answer the following substantial question of law:-
1) Whether the finding of the First Appellate Court that the Defendant No.2 having sold his entire land Ac.0.8.7 decimals in favour of his brother had no further land to convey when he still retains his half share under Ext.6, when in the allotment sheet in the final decree, the Defendants had only Ac.0.07.8 decimals is the outcome of perverse appreciation of evidence on record?
3. Issue notice to the Respondents by Registered Post with AD. Steps be taken within a week hence. In that event, notice be issued fixing a short returnable date.
4. The matter be listed immediately after service of notice upon the Respondents.
