06. 1. Heard Mr. S.S.K. Nayak, learned counsel for the Petitioner as well as Mr. Sonak Mishra, learned Additional Standing Counsel for the State-Opposite Parties.
2. Mr. Mishra submits that the earlier judgment of this Court mentioned in the order dated 04.10.2023 will not apply to the present facts of the case for the reason that once the A.S.O. declared himself as functus officio, he should not have proceeded directing recording of ROR in favour of the Petitioner and as per Rule 34 of the O.S.S. Rules, the Tahasildar is the competent authority having jurisdiction for the same.
3. List this matter on 30th November, 2023.
4. The interim order dated 27.07.2023 shall continue till 30th November, 2023.
