02. 1. Mrs. R. Rajgarhia, learned advocate appears on behalf of applicant/appellant-husband. She submits, by judgment dated 5th April, 2023 the Family Court directed monthly maintenance without any basis. Her client did not get opportunity to contest the proceeding, being away in Hyderabad.
2. She submits, three applications have been made. One for condonation of delay, another for interim stay and the third for amendment. The applications be allowed and the appeal admitted.
3. We find the appeal is reported to have been filed on delay of 33 days. In the circumstances, I.A. no.350 of 2023 stating delay to be six days because applicant had moved the Court below to set aside ex

parte judgment does not require any order to be made therein. It is disposed of.
4. Issue notice on the applications (I.A. nos.283 and 284 of 2023) and the appeal by registered/speed post with AD. Applicant will put in requisites.
5. List on 9th November, 2023. Prayer for interim stay will be considered on adjourned date.
