                                         ORDER

01.11.2023 Order No.

08. 1. Heard learned counsel for the Petitioner and learned counsel for the State.

2. The Petitioner is an accused in connection with T.R. Case No.55 of 2020 pending on the file of learned Additional Sessions Judge-cum-Special Judge, Koraput, arising out of Semilliguda P.S. Case No.79 of 2020 for commission of offence alleged under Sections 20(b)(ii)C/29 of the NDPS Act.

3. Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge-cum- Special Judge, Koraput by order dated 08.02.2023 in the aforementioned case, the present BLAPL has been filed.

4. It is submitted by the learned counsel that the Petitioner is in custody since 18.09.2020 on the accusation of possessing contraband (ganja) to the tune of 1000 kgs.

5. Learned counsel for the Petitioner seeks release, inter alia, on the ground of tardy progress in trial and release of the co- accused by this Court by order dated 29.09.2023 in BLAPL No.7862 of 2023.

7. Learned counsel for the State opposes the prayer for bail in view of the bar contained in Section 37(1)(b)(ii) of the NDPS Act.

8. It is also his further submission that there are distinguishing features so far as the present Petitioner is concerned.
