02. 1. Heard learned counsel for the Petitioner and learned counsel for the State.
2. On instruction, learned counsel for the State submits that PR and counter PR vide Berhampur P.S. Non FIR No.56 & 57 dated 17.05.2023 under Section 107 Cr.P.C. have been submitted to the court of learned S.D.J.M., Nilagiri. The said instruction is taken on record.
3. In view of the same, no further order can be passed in the case at hand. It shall be open to the Petitioner to take recourse in terms of the judgment of the apex Court in the case of Lalita Kumari vrs. State of Uttar Pradesh and others reported in (2012) 4 SCC 1, if so advised.
