01. 1. Heard learned counsel for the Petitioner and learned counsel for the State.

2. The Petitioner was working as P.E.T in the School which was taken over by the Government. Non grant of 3rd RACP is his grievance ventilated in the present writ petition.

3. Considering the limited nature of grievance and since the Petitioner is aged about 59 years, this Court is persuaded to direct the concerned authority to consider the claim of the Petitioner treating the recitals in the writ petition as his representation.

4. If the Petitioner is similarly situated with others in terms of the order of the Apex Court in SLP(C) No.15573 of 2020 disposed of on 04.01.2021, since it is submitted that the Petitioner's claim is covered by the said judgment of the Apex Court, decision in this regard be taken within a period of six weeks from the date of receipt/production of a copy of this order.

5. It shall be incumbent upon the Petitioner to produce the copy of this order along with a copy of the writ petition before the concerned authority.

6. The Writ Petition is accordingly disposed of.

7. Issue urgent certified copy of this order as per rules.
