                           4.             1.      This matter is taken up through hybrid mode.

2. None appears for the Petitioner at the time of call.

3. Judgment dated 30th August, 2017 (Annexure-2) passed by learned Judge, Family Court, Bhubaneswar in Criminal Proceeding No.13 of 2015 is under challenge in this RPFAM, whereby the Petitioner has been directed to pay maintenance of Rs.3,900/- per month to each of Opposite Party Nos.1 and 2 from the date of filing of the application, i.e., from 19th January, 2015.

4. There is a delay of eleven days in filing the RPFAM. Although Misc. Case No.454 of 2017 has been filed for condonation of delay, but the same has not yet been moved.

5. Since none appears for the Petitioner, Misc. Case No.454 of 2017 is dismissed. Consequently, the RPFAM stands dismissed being barred by limitation.

6. Interim order dated 11th January, 2018 passed in Misc. Case No.460 of 2017 stands vacated.
