07. 1. Learned counsel appearing for the Petitioner states that he will withdraw the present petition with liberty to file a fresh application under Section 457 Cr.P.C. for it to be considered in accordance with law as explained by this Court Ashis Ranjan Mohanty (Adv.) v. State of Odisha 2022 (I) OLR 555.
2. If such application is filed, it will be considered afresh by the concerned court independent of the impugned order and in accordance with the aforesaid mentioned judgment of this Court as expeditiously as possible.
3. The CRLMC is disposed of as withdrawn with liberty as prayed for in the above terms.
