01. 1. Learned counsel for the Appellants points out that although the five others ex-employees who are junior to the Respondent No.1 specifically exercised their option to be governed by the Pension Scheme, Respondent No.1 herein did not and, therefore, he stood on a different footing. Further, he had already received the entire retiral benefits upon his retirement.
2. Notice be issued to Respondent No.1 by registered/speed post with A.D., making it returnable before the next date, requisites for which shall be filed within working days. The tracking report be placed on record before the next date.
3. List on 11th September, 2023.

4. There shall be stay of the impugned judgment dated 25th January, 2023 passed by the learned Single Judge in W.P.(C) No.2317 of 2018 till the next date.
