        3.       1.        This matter is taken up through hybrid mode.

2. Judgment dated 30th January, 2017 passed by learned Judge, Family Court, Nayagarh in Crl. M.P. No.299 of 2016 (arising out of C.M.C. No.33 of 2016) is under challenge in this RPFAM, whereby the Petitioner has been directed to pay maintenance of Rs.2,000/- per month to Opposite Party No.1 and Rs.1,000/- per month to each of the Opposite Party Nos.2 and 3 from the date of filing of the application, i.e., from 5th April, 2016.

3. There is a delay of two hundred thirty three days in filing the RPFAM, which has not yet been condoned.

4. Mr. Mishra, learned counsel for the Petitioner by filing a memo prays for withdrawal of the RPFAM. Memo is taken on record.

5. Accordingly, Misc. Case No.468 of 2017 filed for condonation of delay as well as the RPFAM stand dismissed as withdrawn.
