        4.       1.      This matter is taken up through hybrid mode.

2. None appears for the Petitioner at the time of call.

3. Judgment dated 16th October, 2014 (Annexure-5) passed by learned Judge, Family Court, Cuttack in Criminal Proceeding No.177 of 2011 is under challenge in this RPFAM, whereby the Petitioner has been directed to pay maintenance of Rs.5,000/- per month to the Opposite Party from the date of application.

4. Although notice was directed to be issued vide order dated 18th December, 2014, but no step has been taken for issuance of notice to the Opposite Party, as yet.

5. Since none appears on behalf of the Petitioner to pursue the matter, the RPFAM stands dismissed for non-prosecution.

6. Interim order dated 18th December, 2014 passed in Misc. Case No.303 of 2014 stands vacated.

7. Registry shall communicate this order to learned Judge, Family Court, Cuttack forthwith.
