05. 1. For the reasons stated therein, the delay in filing the present writ appeal is hereby condoned.

2. The application for condonation of delay is allowed.

3. The impugned order has been passed by the learned Single Judge exercising jurisdiction under Article 227 of the Constitution against the award of the Industrial Tribunal.

4. In view of the judgment of this Court in Mahammed Saud v. Dr. (Maj) Shaikh Mahfooz 2008(II) OLR (FB) 725 which has been affirmed by the Supreme Court in Mahammed Saud v. Dr. (Maj) Shaikh Mahfooz (2010) 13 SCC 517, the present writ appeal is not maintainable.

5. It will nevertheless be open to the Appellant to seek other appropriate remedies as may be available to the Appellant in accordance with law.

6. The writ appeal is disposed of in the above terms.
