1. For the reasons stated, the I.A. is allowed. The delay in filing the appeal is condoned.

W.A. No.176 of 2019

2. The impugned judgment of the learned Single Judge was passed more than four years ago and in the meanwhile, by way of the implementation of the said order, the Respondent has already commenced the industry in the land in question.

3. In that view of the matter, while leaving the questions of law arising from the impugned judgment open for decision in some other appropriate case and clarifying that it will be confined to the

peculiar facts of the case, the Court does not interfere with the impugned judgment.

4. The appeal is accordingly disposed of with the above observation.
