06. 1. The State is preferred this criminal leave petition against the judgment dated 10th January, 2007 passed by the Ad-hoc Additional Sessions Judge, (F.T.C.), Malkangiri in Criminal Trial No. 44 of 2006 arising out of C.T. No. 38 of 2006 corresponding to Orkel P.S. Case No. 16 of 2005 acquitting the Opposite Party of the offence under Section 302 IPC.
2. Apart from the facts and unexplained delay of 37 days, on examining the case on merits this Court finds that there is no legal error committed by the trial Court in its analysis of the evidence which did not bring home the charge against the Opposite Party.
3. Consequently, the Court is not inclined to interfere in the matter. The Criminal leave petition is dismissed.
