2. Instant appeal is against the impugned judgment in RFA 70/01 of 2013/2008 by the court on learned Additional District Judge, Balasore, a copy of which is at Annexure-1.

3. Considered the submission of Mr. Bose, learned counsel for the appellant.

4. Before disposal of the appeal, the Court is inclined to have the reply of the respondents.

5. Notice to respondents by registered post with A.D. making it returnable at an early date and for the said purpose, learned counsel for the appellant shall file the requisites within a week from today.

2. Till the appearance of respondents, this Court, as an interim measure, stays operation of the impugned judgment as at Annexure-1.
