15. 1. Instant I.A has been filed for extension of stay of this Court's order dated 14th September, 2005 passed in M.C. No. 475 of 2004.

2. Ms. Dash, learned counsel for the appellants submits that this Court in M.C. No. 475 of 2004 by order dated 14th September, 2005 modified its earlier order dated 21st July, 2004 and directed that hearing of the suit may continue till the stage of argument but the judgment shall not be delivered without its leave. It is further submitted that the suit has reached at the stage of argument at present and unless earlier interim order dated 21st July, 2004 is extended further, the very purpose of filing of the appeal would be defeated.

3. An objection from the learned counsel for the respondent is received. However, considering the fact that the appeal is ripe for hearing, the court is of the considered view that interim order dated

21st July, 2004 passed in M.C. No. 475 of 2004 subsequently modified on 14th September, 2005 is required to be extended till the next date.
