    03.     1.      This matter is taken up through Hybrid Arrangement (Virtual
            /Physical Mode).

2. Heard learned counsel for the Petitioner. Perused the Writ Petition as well as the documents annexed to the Writ Petition.

3. It is submitted by the learned counsel for the Petitioner that as against ex parte order passed by the learned Additional District Judge-cum-MACT (III), Titilagarh and rejection of an application under Order 9 Rule 13 of the Code of Civil Procedure by the very same MACT(III), Titilagarh, the Petitioner has approached this Court by filing the present Writ Petition.

4. Upon hearing learned counsel for the Petitioner, this Court is inclined to issue notice to the Opposite Parties. Accordingly notice be issued to the Opposite Parties by registered post with A.D. fixing a short returnable date. Requisites for issue of notice be filed within a week.

7. Accept one set of process fee.

8. As an interim, it is directed that the impugned judgment dated 26.08.2021 passed by the learned Additional District Judge-cum- M.A.C.T.(III), Titilagarh in M.A.C.No.05 of 2019 shall remain stayed till the next date.

9. Issue urgent certified copy of this order as per Rules.
