01. 1. It is seen that by an order dated 11th July 2022 of the Supreme Court in SLP (Civil) Diary No.29294 of 2018 (Commissioner of Sales Tax, Odisha v. M/s. Essel Mining and Industries Ltd.), the issue arising in the present case, which also arose in the above case, has been referred to a Larger Bench of the Supreme Court of India.

2. In that view of the matter, while adjourning the present petition sine die awaiting the judgment of the Supreme Court in the above matter, liberty is granted to the learned counsel for the Department to mention for listing after disposal of the above case by the Supreme Court.
