01. 1. It is contended that a Division Bench of this Court vide judgment dated 12.05.2021 passed in W.P.(C) No.8100 of 2019 titled as BM, The Urban Co-operative Bank Ltd., Cuttack vrs. Registrar, Debts Recovery Tribunal and Another, has categorically held that the limitation in filing the securitization application cannot be condoned by the DRT, hence the impugned orders passed by the DRT confirmed by the order dated 20.09.2022 to that extent by the DRAT are liable to be set aside.

2. Issue notice for 5th April, 2023 to the opposite parties through Registered Post/Speed Post with A.D. Requisites be filed within seven working days.

List on 5th April, 2023.

3. Till the next date, further proceedings before the DRT in S.A. No.22 of 2018 shall remain stayed.
