                3.    1.        This matter is taken up through Hybrid mode.

2. None appears for the Petitioners at the time of call.

3. This RPFAM has been filed assailing the judgment and order dated 4th December, 2013 (Annexure-1) passed by learned Judge, Family Court, Cuttack in Cr.P. No.713 of 2009, whereby the Opposite Party has been directed to pay maintenance at the rate of Rs.500/- to Petitioner No.2 with effect from the date of filing of the case refusing maintenance to Petitioner No.1.

4. On perusal of the order sheet, it appears that after filing of the RPFAM on 20th November, 2015 no step has been taken to get the matter listed. Even defect pointed out by SR has not been removed. As such, the Petitioners lost interest to pursue the matter.

5. Accordingly, the RPFAM is dismissed for non- prosecution.
