        2.       1.        This matter is taken up through hybrid mode.

2. Judgment and decree dated 20th August, 2009 and 5th September, 2009 respectively passed by learned Civil Judge (Senior Division), Aska in C.S. No.73 of 2003 is under challenge in this appeal, whereby the Appellant has been directed to pay a sum of Rs.1,000/- per month to the Respondent No.1 (minor son) till he attains majority.

3. Mr. Jena, learned counsel for the Petitioner by filing a memo prays for withdrawal of the appeal. Memo is taken on record.

4. In view of such submission, the appeal is dismissed as not pressed.
