02. 1. Mr. Das, learned senior advocate appears on behalf of

petitioners and presses for hearing. He submits, he will be rely on

judgment of the Supreme Court in State of Maharashtra vs.

Milind, reported in AIR 2001 SC 393, paragraph 35.

2. Ms. Pattanaik, learned advocate, Additional Government

Advocate appears on behalf of State and prays for extension of time

to file counter. The prayer is opposed by Mr. Das. He submits, in

event time is granted there should be direction for interim protection.

3. Time to file counter is extended. It be filed by 3rd February,

2023, as prayed for by Ms. Pattanaik. Petitioners may file rejoinder

on adjourned date, upon advance copy served.

4. List on 10th February, 2023. There will be stay of operation of

impugned order till next date of hearing.
