2. The Petitioner in this RPFAM seeks to assail the judgment dated 17th February, 2006 passed by learned Judge, Family Court, Cuttack in Criminal Proceeding No.906 of 2002, whereby an application filed by the Petitioner under Section 125 Cr.P.C., has been rejected.

3. Mr. Dhal, learned counsel for the Petitioner submits that he has no instruction in the matter. Step for substitution of deceased Opposite Party No.2 has also not been taken.

4. Accordingly, the RPFAM stands dismissed for non- prosecution.
