3. This CMP has been filed assailing the judgment dated 12th February, 2015 (Annexure-3) passed by learned Additional District Judge, Angul in F.A.O. No.04 of 2014, whereby dismissing the appeal order dated 20th December, 2013 (Annexure-2) passed by learned Civil Judge (Senior Division), Angul in CMA No.472 of 2013 (arising out of C.S. No. 129 of 2005) filed under Order XXII Rule 9 C.P.C., was confirmed.

4. Since none appears on behalf of the Petitioner to pursue the matter, the CMP stands dismissed for non-prosecution.
