21. 1. Mr. Kanungo, learned senior advocate appears on behalf of
appellant-husband. He submits, by impugned judgment dated 14th
April, 2016 his client's petition for divorce was dismissed and
counter-claim for restitution, allowed. Several attempts at mediation
yielded no result. Nevertheless, his client is willing to pay some
permanent alimony to obtain closure from litigation.
2. Mr. Nayak, learned advocate appears on behalf of respondent-
wife and submits, his client is keen to go back to her husband. On
query from Court he has been unable to demonstrate his client applied
for execution.

3. We are satisfied that parties cannot reconcile. In the
circumstances, the appeal is to be heard.
4. List on 9th January, 2024.
