2. Upon hearing Mr. P.K. Kar, learned counsel for the Appellant, Mr. P.K. Nayak, learned counsel for the Respondent No.1 and Mr. G.N. Rout, learned counsel for the State appearing for the Respondent Nos.2 and 3 and on going through the judgments passed by the Courts below, the following substantial question of law is framed for being answered in this Appeal:-
"Whether the Courts below accepting the pleadings of the Plaintiff remaining uncontroverted and the evidence remaining unchallenged could have gone to decree the suit granting the reliefs as prayed for against the Defendants?"
3. On consent of the learned counsel for the parties, the matter is taken up for hearing.
