1. This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

2. Heard learned counsel for the appellant.

3. It is submitted by the learned counsel for the appellant that the deficit court fee has already been paid in the meantime.

4. In such view of the matter, Registry is directed to verify and accept the same.

5. I.A. is accordingly disposed of.

6. The statutory deposit made through A/C Payee cheque of Rs.25,000/- be invested in interest bearing fixed deposit in the name

of the Registrar (Judicial) of this Court in any Nationalised bank for a period of one year and be renewed from time to time at a spell of one year till disposal of the appeal.

7. This is an application for condonation of delay.

8. Heard learned counsel for the Appellant.

9. Issue notice on the question of limitation by registered post with A.D. to the respondents fixing a short returnable date. Requisites for issue of notice be filed by Friday (08.12.2023).

10. List this matter after service of notice on the respondents.

11. It is submitted by the learned counsel for the appellant that MAC case out of which this MACA arises has been disposed of by a common judgment in two MAC cases. So far MACA No.1022 of 2023 is concerned, certified copy of the impugned award has been filed in MACA No.1022 of 2023.

12. In such view of the matter, filing of the certified copy is dispensed with in the present case.

13. I.A. is disposed of.
