03. 1. Mr. Bhuyan, learned advocate appears on behalf of applicant

and submits, by order dated 10th August, 2017 made earlier in the writ

petition, while it was pending, his client's application for intervention

was allowed. However, it will appear from judgment dated 20th

September, 2022, his client was not represented and heard. This

inspite of direction in said order for name of intervener counsel to be

reflected in the cause list.

2. Mr. Dhal, learned advocate appears on behalf of opposite

party no.1 in the writ petition and Mr. Sahoo, learned advocate, for

writ petitioner.

3. Mr. Sahoo submits, intervener chose not to appear on dates of

hearing of the writ petition. Court could not thereby be prevented to

proceed with the adjudication of it and judgment dated 20th

September, 2022 was made by co-ordinate Bench. The judgment was

confirmed by the Division Bench on writ appeal. The application be

dismissed.

4. Court notices entry no.11 in assignment list of the Hon'ble

Mr. Justice Biswanath Rath. It provides for single Judge writ up to the

year, 2010. The writ petition is of year, 2000. In the circumstances,

the application made in it is covered by said entry.

5. The application along with the writ file are released from the

list, to be placed before the Bench having assignment.
