07. 1. None appears for the petitioner when the matter is called.

2. The writ petition was filed in the year 2014 for implementation of the judgment passed by the learned State Education Tribunal dated 28.02.2011 in Execution Case No.170 of 2011 arising out of Appeal Case No.48 of 2006. By the said judgment dated 28.02.2011, learned Tribunal had directed that the present petitioner who was appellant before the Tribunal to continue to the post of Head Clerk.

3. Learned Additional Government Advocate for the State brings to the notice of this Court the letter dated 13.04.2015 addressed to the Advocate General, Odisha, Cuttack, wherein the following has been stated: "Directorate of Higher Education, Odisha, Bhubaneswar. Office Order No.13878// Dt.13.4.2015 Pursuant to Govt. Order No.5536/HE dt.09.3.15 appeal case No.48/06, Execution Case No.170/11, W.P.(C) No.11791/14 and SLP(CC) No.686/15, the D.H.E. (O) has been pleased to accord his approval for promotion of Sri Manmohan Mishra from the post of Sr.

Clerk to the post of head clerk (D.P.)Jatni College, Jatni, Dist-Khurda with effect from 01.04.2004 against the vacant post caused due to the retirement of Narayan Pattnaik w.e.f. 31.03.2004 in the scale of pay Rs.5000- 150-8000 under O.R.S.P. Rules 1998 till his retirement.

This order No.24592 dt.26.5.2006 be carried out immediately. This case may not be cited as a precedent case.
