Order No. 22.08.2023 1. 1. This matter is taken up through hybrid mode.
2. Judgment dated 22nd August, 2019 (Annexure-1) passed by learned Judge, Family Court, Balasore in Misc. Case No.66 of 2018 (arising out of Cr.P. No.694 of 2010) is under challenge in this RPFAM, whereby disposing of an application under Section 127 Cr.P.C., the Petitioner has been directed to pay maintenance at the enhanced rate of Rs.5,000/- per month to the Opposite Party from the date of filing of the petition, i.e., from 13th February, 2018.
3. Mr. Das, learned counsel for the Petitioner submits that although learned Advocate appearing for the Petitioner (Opposite Party therein) before learned Judge, Family Court, Balasore intimated that the matter has been settled between the parties, but he has no concrete instruction in the matter. In spite of his best efforts, he could not contact the Petitioner to obtain any instruction.

4. It appears that although the matter was filed on 13th September, 2019, but since then, neither any step has been taken to remove the defects nor to get the matter listed.
5. In view of the above, the RPFAM is dismissed for non- prosecution.
