4. 1. Mr. Mohapatra, learned advocate appears on behalf of

petitioners and submits, impugned is judgment dated 16th April, 2022

rejecting the application, made as per procedure provided in rule 4-A

of Odisha Hindu Religious Endowments Rules, 1959 for issuance

'no objection' under section 19-A in Odisha Hindu Religious

Endowments Act, 1951. He refers to report dated 1st July, 2021 made

by the Divisional Inspector of Endowments (DIE) to submit, no

evidence was found to show that the institution is a public one. Yet

impugned order denying the certificate.

2. Mr. Sharma, learned advocate, Additional Government

Advocate appears on behalf of State. Ms. Naidu, learned advocate

appears on behalf of the Commissioner and points out from impugned

order, inter alia, Manoj Kumar Pattnaik and Uma Sankar Sahu were

two persons who were raised objection, claiming public institution.

3. Petitioners will obtain particulars regarding aforesaid two

persons and file consolidated cause title to effect their addition as

opposite parties, directed by us. The consolidated cause title be

circulated to appearing learned advocates.

4. Issue notice along with this order on added opposite parties by

registered/speed post with AD. Petitioners will put in requisites.

5. List on 25th September, 2023.
