04. 1. This matter is taken up through Hybrid Mode.

2. Heard Mr. Brundaban Rout, learned counsel appearing for the Petitioner and Mr. P.K. Muduli, learned Additional Government Advocate (AGA) for the Opposite Parties-State.

3. In response to the order dated 2nd August, 2023 of this Court, Mr. P.K. Muduli, learned AGA has produced a written instruction dated 28th August, 2023 by the Tahasildar, Kanika. A copy of the said written instruction has been supplied to Mr. Brundaban Rout, learned counsel appearing for the Petitioner. The said written instruction is taken on record.

4. We direct the Tahasildar, Kanika to give a detailed report regarding the settlement on the ceiling surplus land and details of persons who have been given settlement.

5. We also direct the Tahasildar, Kanika to state in the report what action has been taken after disposal of the suit. Mr. Brundaban Rout, learned counsel for the Petitioner has categorically stated that Civil Suit No.138 of 1992, earlier referred as the suit, has been disposed of and its judgment and order reached their finality. Whether due action has been taken by him (the Tahasildar) in compliance to the order dated 5th March, 2004 passed in OLR Ceiling Case No.47 of 1974, be stated in the report as directed to be filed by the Tahasildar.

6. Let the matter be listed on 31st August, 2023.

7. A copy of this order be supplied to Mr. P.K. Muduli, learned AGA forthwith.
