   01.       1.     Heard learned counsel for the Parties.

2. There is serious allegation of undertaking an exercise by the

Tahasildar, Baranga- Opposite Party No. 2 in Misc. Case No. 18 of

2023 without involvement of the parties likely to be seriously affected

the Petitioners herein. At the same time attention of this Court has

also been drawn to the judgment in the civil suit involved herein to

submit that the preparation of Record of Rights directed by the

Tahasildar, Baranga-Opposite Party No. 2, vide Annexure-5 remain

incomplete and contrary to the judgment involved herein.

3. To find out the allegation through the records of the Tahasildar,

Baranga, this Court while directing service of two copies of the brief

on learned State Counsel by 29.08.2023, as undertaken and learned

State Counsel is directed to produce record involving proceeding vide

Misc. Case No. 18 of 2023 on the next date of posting.

3. In the meantime if the order at Annexure-5 is not given effect

to, the same may not be given effect to till disposal of the Writ

Petition.
