01. 1. Learned counsel for the Respondents states that the present appeal being similar to W.A. No. 777 of 2021 and Batch of Writ Appeals (State of Odisha v. Patitapaban Dutta Dash) dismissing the appeals filed by the State vide judgment of this Court date 12th April 2023, the present appeal may also be dismissed.

2. Learned Additional Standing Counsel for the State does not dispute this position.

3. Accordingly, the present writ appeal is also dismissed in terms of the judgment of this Court in Patitapaban Dutta Dash (supra).
