4. 1. This matter is taken up through hybrid mode.
2. Judgment dated 6th July, 2017 (Annexure-1) passed by learned Judge, Family Court, Berhampur, Ganjam in Criminal Proceeding No.162 of 2016 is under challenge in this RPFAM, whereby the Petitioner has been directed to pay maintenance of Rs.4,000/- per month to Opposite Party No.1 and Rs.2,000/- per month to Opposite Party No.2 from the date of filing of the application, i.e., from 3rd August, 2016.
3. Ms. Patro, learned counsel for the Petitioner submits that the matter has become infructuous in the meantime.
4. There is a delay of forty seven days in filing the RPFAM, as pointed out by the S.R., which has not yet been condoned.
5. In view of the submission made, the RPFAM is disposed of as infructuous.
6. Interim order dated 22nd March, 2018 passed in Misc. Case No.426 of 2017 stands vacated.
