2. Mr. R.P. Kar, learned counsel for the petitioner states that the matter is covered by the order dated 05.05.2021 passed by this Court in W.P.(C) No. 188 of 2006 (M/s Krishna Steel Industry v. The Sales Tax Officer and others), wherein this Court relied upon the judgment of the apex Court in the case of Vadilal Chemicals Ltd. v. State of Andhra Pradesh, (2005) 142 STC 76 (SC) and also the order dated 20.04.2021 passed by this Court in STREV No. 28 of 2006 (M/s Bajarangbali Wire Products Pvt. Ltd. v. State of Orissa).

3. Mr. S.K. Pradhan, learned Addl. Standing Counsel appearing for CT & GST seeks time to examine as to whether the above noted judgment is applicable to the present case or not.
