  1.         1.      Heard learned counsel for the Parties.

2. This Court finds, the claim of the Petitioner appearing to be covered by the judgment of this Court passed in W.P.(C) No.5274 of 2022 on 19.7.2022 (Nabakishore Naik vrs. State of Odisha & ors.), vide Annexure-7. However, considering the application at the instance of the Petitioner pending with the Secretary, C.D.A. appearing at Annexure-6, the Secretary, C.D.A., O.P.3 is directed to consider the same keeping in view the observation and direction of this Court involving W.P.(C) No.5274 of 2022 disposed of on 19.7.2022 and in the event O.P.3 finds, the Petitioner becomes the single allottee and in enjoyment of the discretionary quota, arrangement for handing over the property will also be made at least within a period of fifteen days hence.

3. The Writ Petition stands disposed of with the above order.
